Progressing to citizenship with ILR

Those who have secured Indefinite Leave to Remain in the UK are often interested in progressing to citizenship, but are unsure of the process or relevant documentation. Applicants who obtained Indefinite Leave to Remain (ILR) through a Skilled Worker route may be eligible to apply for British citizenship 12 months after their ILR was granted. If you are married to a British citizen, you may be eligible to apply for citizenship as soon as you obtain your ILR. Get in touch for expert support with this last UK immigration hurdle.

Your claim to British citizenship

You might have a claim to British citizenship even if you were not born in the UK, for example if you have a British parent. Fulfilling the good character requirement

If you are considering applying for British citizenship but are unsure whether you can satisfy the ‘good character’ requirement, please contact our team at Changes Immigration for a consultation. Minor offences, such as parking fines and cautions do not necessarily render you ineligible, though they do have to be disclosed. In respect of more serious offences, your eligibility should be carefully assessed before submitting your application. Factors such as the time elapsed since the offence and any rehabilitation efforts may influence the outcome of your application. British citizenship applications explained

An adult’s eligibility for British citizenship is commonly based on having lived in the UK for 5 years and held indefinite leave to remain for 12 months. If you are married to a British citizen, the residency requirement is 3 years. Limits on absences over the 3 or 5-year qualifying period for citizenship usually apply, including a limit of 90 days’ absence in the 12 months before submitting a citizenship application. Children may be eligible based on being born in the UK and their parents’ status, or having a British parent.

 

Applicants have often already satisfied the citizenship application requirement to pass the Life in the UK test and demonstrate English language ability when they applied for indefinite leave to remain. Good character is a strict eligibility requirement that often catches applicants out.

How do I apply for British citizenship?

The citizenship application process involves the following steps:

 

  • Booking and taking an English language test at level B1 or higher;
  • Booking and taking the Life in the UK Test;
  • Completing and submitting an online citizenship application form;
  • Uploading copies of your passport and other required documents to the Home Office;
  • Attending an appointment to submit biometric data;
  • The Home Office will review your application, usually within 6 months; and
  • If your application is approved, you will receive a citizenship ceremony invitation. During the ceremony, you will affirm or swear allegiance to the King, receive a certificate of naturalisation and become a British citizen.

 

After completing the above process, you may apply for your first British passport.
